§ 1. DEFINITIONS

Controller” (“We”, “Our”) – Rebel Wolves sp. z o.o., a Polish limited liability company with the registered office in Warsaw, the registered address: ul. Dereniowa 60 lok. U4, (02-776) Warszawa, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court for the capital city of Warsaw in Warsaw, 13th (XIII) Commercial Division of the National Court Register, with KRS number 0000933935, REGON (Business Statistical Number): 520497877, NIP (Tax Identification Number): 9512529961, having the share capital of PLN 50,000.00 (fifty thousand zloty), fully paid up.

“Data” – personal data – any information about a natural person identified or identifiable by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

“User” or “Customer” (“You”, “Your”) – a natural person using the Platform.

“Platform” – an online platform at shop.rebel-wolves.com.

“GDPR” – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

 

§ 2. CONTROLLER

1.Rebel Wolves sp. z o.o. with its registered office in Warsaw at ul. Dereniowa 60 lok. U4, (02-776) Warszawa is the controller of Customers’ personal data provided during their use of the Platform, including those provided during the registration of a Customer’s account and purchases.

§ 3. PROCESSING OF PERSONAL DATA ON THE PLATFORM

1.Data about a User visiting the Platform may be made available by the User in two ways: by connecting to the Platform and by performing certain actions on or through the Platform.

  1. a) Data collected automatically by the Platform

This Data is automatically recorded by the Platform and includes anonymous information regarding the time of the Customer’s visit, IP address, URL, browser type (known as “system logs”), number of visits, device data, browser language and type of operating system. The automatically collected data is analysed for statistical purposes with the use of the Google Analytics standard solution. This tool operates based on files known as “cookies” and does not provide personally identifiable information. The data collected in the above manner is only stored to support the management of the Platform, enabling its smooth operation and the application of customer-friendly solutions. Google’s Privacy Policy can be accessed at https://www.google.com/intl/en/policies/privacy/. The legal basis for the processing of the above data is Article 6(1)(f) GDPR.  Our legitimate interest stems from our desire to guarantee uninterrupted connection and comfortable use of our website and to ensure the security and stability of the Platform.

  1. b) Data collected as a result of a Customer’s activity
  • Contact inquiries, questions or requests, sent to the Controller’s contact details available on the Platform

The purpose of the processing of the data You have provided, including Your contact or identification data, is to respond to the cases You have initiated in this way, to provide answers or to fulfill Your requests. The legal basis for the processing of Your personal data is the necessity of the processing for the pursuit of Our legitimate interest, namely the ability to respond to Your questions or requests (Article 6(1)(f) GDPR).

  • Participation in recruitment

When You send Your applications or CVs to the contact addresses specified on the Platform, we are given the opportunity to consider Your candidature for an ongoing recruitment process for various positions. The legal basis for data processing is Your consent (Article 6(1)(a) GDPR) – by sending a recruitment application to the Controller, You consent to the processing of the Data contained in the recruitment application by the Controller, as well as all members of the Controller’s capital group, for the purpose of recruiting for the position indicated in an advertisement.

(c) Other purposes and grounds for the processing

  • Performance of contracts, including sales, service, cooperation and confidentiality contracts 

The objects of the Controller include the performance of the subject matter of contracts concluded, including contracts for the distance selling of goods and services. Accordingly, We process the Data necessary for the establishment of the terms, conclusion and performance of the contracts. These include, but are not limited, to the following types of Data:

– name and surname,

– invoicing and delivery address,

– e-mail address,

– payment details,

– telephone number.

The legal basis for the aforementioned processing is Article 6(1)(b) GDPR, which means that You provide us with personal data in order to conclude, and enable us to perform, a contract.

 

  • Performance of the Controller’s legal obligations

We process the Data in order to fulfill statutory obligations, e.g. guidelines from supervisory authorities and retention obligations under commercial and tax law. In this case, the legal basis for data processing is the relevant regulations set out by law in conjunction with Article 6(1)(c) GDPR.

  • The pursuit of the Controller’s legitimate interest, i.e. the exercise of, or defend against, legal claims, as well as analytical and statistical purposes (the legal basis is Article 6(1)(f) GDPR).

2.Data may be transferred to external providers of services to the Controller (e.g. services related to IT systems maintenance, accounting, legal, auditing, consulting and marketing), as well as entities such as banks and payment operators, carriers and couriers. Data may also be transmitted to other entities, including public authorities if such an obligation arises from generally applicable laws.

3.The Controller may transfer Data to third countries, i.e. countries outside the EEA, subject to the following conditions:

  • if the European Commission has found an adequate level of Data protection in the country concerned (a list of these countries is available at https://ec.europa.eu/info/law/law-topic/data-protection/international-dimension-data-protection/adequacy-decisions_en#relatedlinks),
  • in the absence of an adequacy decision by the European Commission, personal data may be transferred to third countries on the basis of binding corporate rules, standard data protection clauses adopted by the European Commission, standard data protection clauses adopted by the Polish supervisory authority and approved by the Commission, an approved code of conduct or an approved certification mechanism,
  • in the absence of the grounds referred to the two preceding subsections, the Controller will request explicit consent for such a transfer by informing You in advance of the risks involved in the transfer.

4.Data processing period

  • In the case of the conclusion of a contract (placement of an order) with the Controller, Data may be processed for the period during which potential claims relating to the contract may arise, until they become time-barred.
  • Where the processing is carried out on the basis of a legal obligation incumbent on the Controller, Data may be processed until such time as the Controller’s obligation to process the Data expires.
  • Where the processing is carried out on the basis of the Controller’s legitimate interest, Data may be processed until receipt of an objection to the processing of personal data. However, where processing is necessary for the purposes of exercising, or defending against, claims, personal data may continue to be processed despite receipt of an objection.
  • If the Controller’s claims are exercised or defended against, Data may be processed until the judgment is enforced.
  • Data may be processed until You withdraw Your consent to the processing if consent has been granted. The withdrawal of consent will have a future effect, which means that it will not affect the lawfulness of any action taken by Us before the withdrawal.
  • Data included in session cookies may be processed for a period of up to two years or until they are deleted from Your browser, while permanent cookies remain in Your browser until they expire or until You delete them from Your browser; once Your IP address has been anonymized, it can no longer be linked to You.
  • Data processed to ensure accountability may, in principle, be stored indefinitely. However, We would like to inform You that this will occur in exceptional cases – e.g. if You object to the processing.
  • When our website is closed, the geolocation Data is deleted.

5.Your provision of Data is voluntary, but failure to do so may prevent You from contacting the Controller or using the services offered by the Controller through the website.

6.Personal Data will not be used for automated decision-making.

7.You have the following rights in relation to the processing of Your personal Data:

  • the right to access Your personal Data processed by the Controller, including the right to be informed about Your personal Data and to obtain a copy of that Data,
  • the right to rectify any incorrect Data,
  • the right to complete any incomplete Data
  • the right to erase Data,
  • the right to restrict Data processing,
  • the right to obtain the Data made available in a structured, commonly used machine-readable format,
  • the right to object to the processing of Your personal Data.

8.In order to exercise the rights set out in paragraph 7, You should contact the Controller.

9.If You consider that the processing of Your personal data violates the GDPR, You can lodge a complaint with the supervisory authority, the President of the Personal Data Protection Office.

 

 § 4. COOKIES

  1. The Platform uses cookies to ensure its convenient and efficient use. A cookie is a small file consisting of numbers or letters that is downloaded to Your computer when You visit certain websites. Cookies enable a website to recognise a User’s device.

  2. The Platform uses the following types of cookies:

    1. session cookies – temporary files that are stored on the end device until You log out, leave the Platform or close Your web browser,

    2. persistent cookies – files that are stored for the time specified in their parameters, i.e. they can remain on the end device for different periods of time – session time, set time or until they are deleted.

  3. Cookies can be stored for a longer period of time or deleted when the search on a given website is completed (which means that the session starts from the moment the User opens the browser window until the moment the user leaves it).

  4. Cookies are used on the Platform for the following purposes:

a) strictly necessary cookies that enable You to use the services available on the Platform, e.g. authentication cookies used for services that require authentication on the Platform or that are used to ensure security, e.g. to detect authentication abuse on the Platform; these cookies cannot be disabled as part of the cookie settings management. However, You can set your browser to block these cookies, but some elements of the website will not work. No personal data is stored in these cookies.

b) marketing cookies, which enable the customisation of advertising content to the User’s preferences;

c) analytical cookies, which enable the collection of information on the use of the Platform’s websites and contribute to improving the performance of the Platform and are used for internal purposes only. This data is anonymous and does not allow for the identification of a specific User;

d) social platforms cookies that belong to social platforms and which enable the sharing of our website content on the social platforms Facebook, X (formerly Twitter) i LinkedIn. These cookies link our website to, and are controlled by, these platforms. Thanks to these cookies, we have the ability to link Users’ accounts to content on our website, i.e. user authentication. These cookies are responsible for the ability to add comments or enable the delivery of adverts on these platforms.

  1. When You use the Platform, (external) cookies from third-party providers, in particular from service providers such as Google or Facebook, may also be placed on Your device to enable You to use the functionalities of our website integrated into these services. Each of these third-party providers sets out its own rules for the use of cookies in its privacy policy.

  4. Modification of the cookie settings

In many cases, web browsers allow cookies to be stored on the User’s end device by default. Platform Users can change the cookie files settings at any given time. Specifically, the web browser allows the Platform User to change these settings in such a way as to block the automatic use of the cookie files or to inform the User of every single act of placing a cookie file on their device. In accordance with the applicable provisions of the Telecommunications Law Act of 16 July 2004 (Journal of Laws No. 171, item 1800, as amended), the User has the right to decide on the access of cookies to their computer by selecting the appropriate settings in advance in their browser window.

At the same time, the Controller points out that restrictions on the use of cookies may affect some of the functionalities available on the Platform and, for example, prevent access to these functionalities.

In order to change the settings of cookies used by the Platform, You must also make a change in the Cookies – Settings tab.

§ 5. PIXELS

1.The Platform contains plug-ins (known as “pixels”) that enable connection to social networks managed by other Controllers.

2.The Controller has no influence over the security and processing policies of the controllers of social networks. The Controller recommends that You should consult data protection policies of the controllers of these websites.

3.Platform plug-ins

  • Facebook

The Platform uses social plug-ins of the facebook.com network operated by Facebook Inc. of 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”).

Detailed information on Facebook data protection rules can be obtained at http://www.facebook.com/help/?faq=17512. We do not know the purpose and scope of the collection of personal Data and how the data is further processed by Facebook; however, it is possible to block Facebook social plug-ins in Your browser using appropriate blockers (e.g. the Facebook Blocker).

  • Instagram

The Platform uses Instagram social plug-ins operated by Instagram LLC of 1601 Willow Road, Menlo Park, CA 94025, USA (“Instagram”). The plug-ins are marked with the Instagram logo, the Instagram Camera.

When You visit our website, Your browser opens a direct connection to the Instagram servers. Detailed information on Instagram data protection rules can be obtained at https://help.instagram.com/155833707900388/. We do not know the purpose and scope of the collection of personal Data and how the data is further processed by Instagram; however, it is possible to block Instagram social plug-ins in Your browser using appropriate blockers (e.g. the Instagram Blocker).

  • LinkedIn

The Platform uses LinkedIn social plug-ins operated by LinkedIn Corporation of 2029 Stierlin Court, Mountain View, CA 94043, USA (“LinkedIn”). The Platform uses the YouTube video platform operated by YouTube, LLC of 901 Cherry Ave. San Bruno, CA 94066, USA (“YouTube”).

§ 6. GOOGLE ANALYTICS

1.The Platform uses Google Analytics, a web analytics service of Google Inc. of 1600 Amphitheatre Parkway Mountain View, CA 94043, USA.  Google Analytics uses cookies and information about Your use of the Platform, created by cookies, is transmitted to a Google server in the USA.

§ 7. FINAL PROVISIONS

The Controller may amend this policy from time to time for cause in order to improve personal data protection standards, change the use of cookies or comply with generally applicable laws. The revised policy will be published on the Platform and also sent to Your email address.

 

 

CONTROLLER’S DATA PROCESSING NOTICE

RELATED TO THE USE OF FACEBOOK, LINKEDIN, TWITTER AND YOUTUBE FANPAGES

 

1.Purposes and grounds for processing personal data in the operation of the Controller’s fanpages


The operation of the Controller’s fanpage on the social network sites Facebook, LinkedIn, Twitter and YouTube, in accordance with the terms and conditions laid down by the owners of the said sites, which includes but is not limited to

  • the provision of information about the Controller’s business to the users of the portal;
  • the conduct of surveys of opinions about the Controller’s business and services;
  • the updating of business-related content;
  • communication between the Controller’s employees and users of the portal.

The basis for such Data processing is that the processing is necessary for the purposes of legitimate interests pursued by the Controller or by a third party (Article 6(1)(f) GDPR).

 

  1. Types of personal data processing

The Controller, as part of the operation of the Controller’s fanpage on Facebook, LinkedIn, Twitter and YouTube (each individually, a “Portal”, collectively, the “Portals”), processes the personal data of persons who follow or have liked the Controller’s fanpage, as well as persons who have published a comment, reaction or opinion, under any of the posts made on the fanpage or elsewhere on the fanpage.


The types of data processed include the name of Your account used to access a Portal (usually, the first name and surname), the content of Your comments, the data You make available on Your profile on the Portal (including profile pictures and other photos and posts), anonymous statistical data on the fanpage’s visitors, available as part of the functions provided by the Portal and governed by the Portal’s non-amendable terms of use, collected through cookies.

  1. Data recipients

The Controller may transfer personal data to processors of personal data on behalf of the Controller. The processors are, in particular, the owners of individual Portals (Facebook Ireland Ltd., LinkedIn Corporation, Twitter Inc., YouTube, LLC).

In such a situation, the processing is carried out on the basis of the non-amendable data processing rules defined by a Portal. Furthermore, data may be made available to entities involved in the operation and maintenance of IT systems and websites, as well as to entities supporting the Controller’s marketing activities, including those operating the social media fanpage services, but only to the appropriate extent and on the basis of the concluded data processing agreements, which ensures the security of Your personal Data.

  1. Data retention period

Your Data will be stored until the Controller’s legitimate interests, serving as a basis for the processing, are fulfilled or until You object to such processing. After that, Your Data will be erased.

  1. Rights

You have the right to access the content of Your personal Data and the right to rectification, as well as the right to erasure or restriction of processing and the right to object to processing. You also have the right to lodge a complaint with the supervisory authority – the President of the Personal Data Protection Office.

  1. Automated decision-making

Data processed for the Controller’s legitimate purposes will not be subject to automated decision-making, including profiling.

  1. Data is provided on a voluntary basis.If You do not provide Your Data, You will not be prevented from using a fanpage. However, access to some of its functions, such as subscribing to the fanpage, following the fanpage and adding reactions, comments and opinions, is subject to the provision of Your Data.
  1. Transfer of data to third countries
    Due to the fact that the services provided by the Portals have a global reach, the use of the Portals may result in Your Data being transferred to countries outside the European Economic Area (“third countries”) under the non-amendable data transfer rules defined by the respective Portal. Information on the rules for data processing by the various Portals which include sources of more information in this respect is available in §5 of this Policy.

Dane – dane osobowe – wszelkie informacje o osobie fizycznej zidentyfikowanej lub możliwej do zidentyfikowania na podstawie identyfikatora takiego jak imię i nazwisko, numer identyfikacyjny, dane o lokalizacji, identyfikator internetowy lub jeden bądź kilka szczególnych czynników określających fizyczną, fizjologiczną, genetyczną, psychiczną, ekonomiczną, kulturową lub społeczną, tożsamość osoby fizycznej.

Użytkownik lub Klient – osoba fizyczna, korzystająca z Platformy.

Platforma – platforma internetowa zlokalizowana pod adresem shop.rebel-wolves.com.

RODO – Rozporządzenie Parlamentu Europejskiego i Rady (EU) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (ogólne rozporządzenie o ochronie danych).

 

§ 2. ADMINISTRATOR

1. Administratorem danych osobowych Klienta, podawanych podczas korzystania z Platformy, w tym podczas rejestracji konta Klienta oraz dokonywania zakupów  jest Rebel Wolves sp. z o.o. z siedzibą w Warszawie przy ul. Dereniowej 60 lok. U4, (02-776) Warszawa.

§ 3. PRZETWARZANIE DANYCH OSOBOWYCH NA PLATFORMIE

1. Odwiedzając Platformę, dane o Użytkowniku mogą być przez niego udostępniane na dwa sposoby: poprzez łączenie z Platformą oraz poprzez wykonywanie określonych czynności na Platformie lub za pomocą Platformy.

a) Dane pobierane automatycznie przez Platformę

Dane te są automatycznie zapisywane przez Platformę i są to anonimowe informacje dotyczące czasu wizyty Klienta, adres IP, adres URL, rodzaj przeglądarki (tzw. logi systemowe), liczba odwiedzin, dane urządzenia, język przeglądarki, typ systemu operacyjnego. Gromadzone automatycznie dane są analizowane w celu statystycznym, korzystając z rozwiązania standardowego Google Analytics. Narzędzie to działa w oparciu o tzw. pliki cookies i nie udostępnia danych umożliwiających identyfikację Klienta. Zebrane w wyżej opisany sposób dane przechowywane są jedynie w celu pomocniczym dla zarządzania Platformą, umożliwiając sprawne jego funkcjonowanie i stosowanie rozwiązań przyjaznych dla Klienta. Polityka prywatności Google dostępna pod adresem https://www.google.com/intl/pl/policies/privacy/. Podstawę prawną przetwarzania powyższych danych stanowi artykuł 6 ust.1 lit. f) RODO. Nasz uzasadniony interes wynika z dążenia do zagwarantowania niezakłóconego tworzenia połączenia, komfortowego korzystania z naszej strony internetowej oraz zapewnienia bezpieczeństwa i stabilności Platformy.

b) Dane pobierane w wyniku aktywności Klienta

  • Kontakt, pytania lub wnioski, poprzez dane kontaktowe Administratora dostępne na Platformie

Celem przetwarzania danych, podanych przez Państwa, w tym danych kontaktowych lub danych identyfikacyjnych jest reakcja na zainicjowane przez Państwa w powyższy sposób sprawy, udzielenie odpowiedzi lub realizacji wniosków. Podstawą prawną przetwarzania Państwa danych osobowych jest niezbędność przetwarzania do realizacji naszego prawnie uzasadnionego interesu, którym jest możliwość udzielania odpowiedzi na zadane przez Państwa pytania lub wnioski (art. 6 ust. 1 lit. f RODO).

  • Udziału w rekrutacji

W momencie przesłania przez Państwa zgłoszeń lub CV na wskazane adresy kontaktowe na Platformie, uzyskujemy możliwość uwzględnienia Państwa kandydatury w prowadzonej rekrutacji na różne stanowiska. Podstawą prawną przetwarzania danych jest Państwa zgoda (art. 6 ust. 1 lit. a RODO) – wysyłając zgłoszenie rekrutacyjne do Administratora, zgadzacie się Państwo na przetwarzanie przez Administratora, jak również przez wszystkie spółki należące do grupy kapitałowej Administratora, Danych zawartych w zgłoszeniu rekrutacyjnym w celu prowadzenia rekrutacji na stanowisko wskazane w ogłoszeniu.

c) Pozostałe cele i podstawy przetwarzania Danych

  • Realizacja umów, w tym umów sprzedaży, świadczenia usług, o współpracy, o zachowaniu poufności

Przedmiotem działalności Administratora jest m.in. realizacja przedmiotu zawartych umów, w tym umów o sprzedaży na odległość towarów i usług. W związku z tym przetwarzamy dane niezbędne do ustalenia warunków, zawarcia i realizacji umów. Zaliczają się do nich w szczególności:

imię, nazwisko,

adres do faktury i adres dostawy,

adres e-mail,

dane do płatności,

numer telefonu.

Podstawą prawną wymienionego powyżej przetwarzania jest art. 6 ust. 1 lit. b) RODO, co oznacza, że udostępniasz nam dane osobowe w celu zawarcia
i umożliwienia nam realizacji umowy.

    • w przypadku braku przesłanek określonych w dwóch poprzednich podpunktach – Administrator wystąpi o wyrażenie wyraźnej zgody na takie przekazanie informując uprzednio o ryzyku wiążącym się z takim przekazaniem.

4. Okres przetwarzania Danych:

    • w przypadku zawarcia umowy z Administratorem (złożenie zamówienia) – przez okres, w którym mogą powstać potencjalne roszczenia związane z umową, do czasu ich przedawnienia,
    • w przypadku gdy przetwarzanie odbywa się na podstawie obowiązku prawnego ciążącego na Administratorze – do czasu gdy obowiązek przetwarzania danych przez Administratora wygaśnie,
    • w przypadku gdy przetwarzanie odbywa się na podstawie uzasadnionego interesu Administratora – do czasu otrzymania sprzeciwu wobec przetwarzania danych osobowych, jednak w przypadku gdy przetwarzanie jest niezbędne w celu dochodzenia roszczeń lub obrony przed nimi, dane osobowe mogą być dalej przetwarzane pomimo otrzymania sprzeciwu,
    • w przypadku dochodzenia roszczeń lub obrony przed roszczeniami, do czasu wykonania orzeczenia.
    • do momentu wycofania Państwa zgody na przetwarzanie, jeżeli zgoda została udzielona. Wycofanie zgody będzie miało skutek na przyszłość, co oznacza, że nie wpłynie na zgodność z prawem wszelkich działań podjętych przez nas przed jej wycofaniem.
    • w zakresie plików cookies sesyjnych przez okres do 2 lat lub do czasu ich usunięcia z przeglądarki internetowej, z kolei w zakresie plików stałych cookies pozostają w przeglądarce do momentu terminu ich wygaśnięcia lub do momentu ich usunięcia przez użytkownika z przeglądarki; po anonimizacji adresu IP jego powiązanie z Państwa osobą nie jest już możliwe.
